Every quote is given on the basis of a straightforward transaction
The fees quoted in this document, and in any written quotation we give you, are calculated on the basis that your transaction is a straightforward one and that no unforeseen matters arise. Where a matter turns out to be more complex, more time-consuming or higher risk than a straightforward transaction, we reserve the right to charge an additional fee. We will always tell you before any additional charge is incurred, explain why it is needed and agree the amount with you first. You will never receive an unexpected bill from us.

1.5 Disbursements on a purchase
Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

1.6 Additional disbursements on a leasehold purchase
These fees are set by the landlord or the management company and are stated in the lease. They vary from property to property and can on occasion be significantly more than the ranges given below. We can only confirm the actual figures once we have received the management pack.

Insurance premiums are subject to Insurance Premium Tax rather than VAT. Whether searches are required, and which ones, is determined by your new lender; where the lender accepts search indemnity insurance this is usually the cheaper option and we will tell you which applies.
4. The Basis of Our Quotation
4.1 Our quote assumes a straightforward transaction
Every fee quoted in this document, and every written quotation we provide, is given on the basis that your matter is a straightforward transaction and that no unforeseen matters arise. Our quotation assumes that:
- this is a standard transaction and no unforeseen matters arise, including (but not limited to) the discovery of a defect in title which requires remedying before completion, or the preparation of any additional documents ancillary to the main transaction;
- the property is registered at HM Land Registry with an absolute title;
- the property is freehold or (where the leasehold scale applies) the transaction is the assignment of an existing lease and not the grant of a new lease;
- the property is not a new build property and no Help to Buy or equivalent scheme mortgage is required;
- the transaction is concluded in a timely manner and no unforeseen complications arise;
- all parties to the transaction are co-operative and there is no unreasonable delay from third parties in providing documentation;
- no indemnity policies are required (additional disbursements will apply if indemnity policies are required);
- no more than two individuals are buying, selling or borrowing, all of whom are UK resident and able to provide standard identification and source of funds evidence; and
- the transaction proceeds to completion.
4.2 When an additional fee may apply
We reserve the right to use our discretion to increase our legal fees where a matter proves to be more complex, more time-consuming or of higher risk than a straightforward transaction. Circumstances in which an additional fee is likely to apply include:
- the title is unregistered, defective or requires rectification;
- an indemnity insurance policy is required, or a statutory declaration or deed of rectification must be prepared;
- the transaction involves a gifted deposit, or funds are being provided by a third party;
- a declaration of trust or deed of trust is required to record how the property is held;
- a Help to Buy ISA, Lifetime ISA, Help to Buy equity loan, shared ownership, right to buy or other scheme is involved;
- a deed of covenant, licence to assign, certificate of compliance or landlord’s consent is required;
- a lease extension, deed of variation or the purchase of a freehold reversion is required;
- the property is a new build, is being purchased off plan, or involves a management company, estate rentcharge or private drainage;
- the property is tenanted, is being bought or sold as an investment, or forms part of a portfolio;
- the transaction involves a company, trust, pension fund or a client based outside the United Kingdom, or additional anti-money laundering and source of funds work is required;
- the transaction is being expedited at your request or that of another party, or an undertaking as to keys or early occupation is required;
- a matrimonial, probate, bankruptcy, restriction, notice or Form RX1 / RX3 issue arises on the title;
- we are required to complete lender-specific forms, disclosures or portals beyond the standard Certificate of Title; or
- the transaction is aborted after work has been undertaken (see below).
4.3 Aborted transactions
If your transaction does not proceed to completion, we will charge for the work carried out up to the point the matter is aborted, on a fair and proportionate basis by reference to the stage the transaction had reached, together with any disbursements we have incurred on your behalf. Our abortive charge will not exceed the fee originally quoted.
4.4 VAT
All fees are quoted exclusive and inclusive of VAT, which is charged at the prevailing rate, currently 20%. Some disbursements are not subject to VAT, for example HM Land Registry fees, Stamp Duty Land Tax and Land Transaction Tax. Should the rate of VAT change before your matter completes the rate applicable at the date of our invoice will apply.
4.5 Referral fees
We do not pay referral fees for our residential conveyancing work.
4.6 Supervision and our people
All residential conveyancing work undertaken by this firm is supervised by a qualified and experienced Solicitor. You will be told at the outset who is handling your matter, their status, and who supervises them. Regardless of who works on your matter, they will be supervised by a member of our residential property team.

3. Remortgages
3.1 Remortgage — our legal fees

Where the price exceeds £500,000, our fee is quoted on enquiry. Please contact us with the details of the property and we will provide a written quotation.
Where the property is leasehold, an additional fee of £150 excluding VAT (£180 including VAT) applies to reflect the additional work of reviewing the lease and serving notice on the landlord.
3.2 What our fee covers
Our fee covers the work required to complete the remortgage of your property, including redeeming your existing mortgage, complying with your new lender’s requirements and dealing with registration of the new charge at HM Land Registry.

Insurance premiums are subject to Insurance Premium Tax rather than VAT. Whether searches are required, and which ones, is determined by your new lender; where the lender accepts search indemnity insurance this is usually the cheaper option and we will tell you which applies.
4. The Basis of Our Quotation
4.1 Our quote assumes a straightforward transaction
Every fee quoted in this document, and every written quotation we provide, is given on the basis that your matter is a straightforward transaction and that no unforeseen matters arise. Our quotation assumes that:
- this is a standard transaction and no unforeseen matters arise, including (but not limited to) the discovery of a defect in title which requires remedying before completion, or the preparation of any additional documents ancillary to the main transaction;
- the property is registered at HM Land Registry with an absolute title;
- the property is freehold or (where the leasehold scale applies) the transaction is the assignment of an existing lease and not the grant of a new lease;
- the property is not a new build property and no Help to Buy or equivalent scheme mortgage is required;
- the transaction is concluded in a timely manner and no unforeseen complications arise;
- all parties to the transaction are co-operative and there is no unreasonable delay from third parties in providing documentation;
- no indemnity policies are required (additional disbursements will apply if indemnity policies are required);
- no more than two individuals are buying, selling or borrowing, all of whom are UK resident and able to provide standard identification and source of funds evidence; and
- the transaction proceeds to completion.
4.2 When an additional fee may apply
We reserve the right to use our discretion to increase our legal fees where a matter proves to be more complex, more time-consuming or of higher risk than a straightforward transaction. Circumstances in which an additional fee is likely to apply include:
- the title is unregistered, defective or requires rectification;
- an indemnity insurance policy is required, or a statutory declaration or deed of rectification must be prepared;
- the transaction involves a gifted deposit, or funds are being provided by a third party;
- a declaration of trust or deed of trust is required to record how the property is held;
- a Help to Buy ISA, Lifetime ISA, Help to Buy equity loan, shared ownership, right to buy or other scheme is involved;
- a deed of covenant, licence to assign, certificate of compliance or landlord’s consent is required;
- a lease extension, deed of variation or the purchase of a freehold reversion is required;
- the property is a new build, is being purchased off plan, or involves a management company, estate rentcharge or private drainage;
- the property is tenanted, is being bought or sold as an investment, or forms part of a portfolio;
- the transaction involves a company, trust, pension fund or a client based outside the United Kingdom, or additional anti-money laundering and source of funds work is required;
- the transaction is being expedited at your request or that of another party, or an undertaking as to keys or early occupation is required;
- a matrimonial, probate, bankruptcy, restriction, notice or Form RX1 / RX3 issue arises on the title;
- we are required to complete lender-specific forms, disclosures or portals beyond the standard Certificate of Title; or
- the transaction is aborted after work has been undertaken (see below).
4.3 Aborted transactions
If your transaction does not proceed to completion, we will charge for the work carried out up to the point the matter is aborted, on a fair and proportionate basis by reference to the stage the transaction had reached, together with any disbursements we have incurred on your behalf. Our abortive charge will not exceed the fee originally quoted.
4.4 VAT
All fees are quoted exclusive and inclusive of VAT, which is charged at the prevailing rate, currently 20%. Some disbursements are not subject to VAT, for example HM Land Registry fees, Stamp Duty Land Tax and Land Transaction Tax. Should the rate of VAT change before your matter completes the rate applicable at the date of our invoice will apply.
4.5 Referral fees
We do not pay referral fees for our residential conveyancing work.
4.6 Supervision and our people
All residential conveyancing work undertaken by this firm is supervised by a qualified and experienced Solicitor. You will be told at the outset who is handling your matter, their status, and who supervises them. Regardless of who works on your matter, they will be supervised by a member of our residential property team.
